1. Acceptance of Terms

By accessing or using Clawfather's services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting.

2. Description of Services

Clawfather provides a platform for deploying and managing OpenClaw AI agent instances on virtual private servers (VPS). Our services include automated server provisioning, API key management, monitoring, and support services. We reserve the right to modify, suspend, or discontinue any part of our services at any time.

3. Account Registration

To use our services, you must:

  • Be at least 18 years of age or have legal capacity to enter into contracts
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account and password
  • Accept responsibility for all activities that occur under your account

4. Subscription and Billing

Our service is offered on a subscription basis:

  • Subscription fees are billed in advance on a monthly basis
  • All payments are processed through Stripe
  • You are responsible for all charges incurred under your account
  • Subscription fees are non-refundable except as required by law
  • We reserve the right to change pricing upon 30 days notice

5. Instance Usage and Limits

Your use of instances is subject to the following conditions:

  • Instance creation is limited by your subscription tier
  • You may not use instances for illegal activities
  • You may not use instances to send spam or malicious content
  • You may not attempt to gain unauthorized access to other systems
  • We reserve the right to suspend instances violating these terms

6. API Keys and Credentials

You are responsible for maintaining the confidentiality of your API keys and credentials. You agree to use API keys from legitimate providers only (Anthropic, OpenAI, OpenRouter, etc.) and in compliance with their respective terms of service. Clawfather is not responsible for misuse of API keys or violations of third-party terms.

7. Data and Content

You retain ownership of any data you store on your instances. By using our services, you grant us a limited license to access and process your data solely for the purpose of providing and improving our services. We do not monitor the content of your instances except as necessary for technical support or as required by law.

8. Prohibited Activities

You may not use our services to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware, viruses, or harmful code
  • Engage in unauthorized data mining or scraping
  • Impersonate others or provide false information
  • Interfere with or disrupt our services or servers
  • Attempt to circumvent security measures

9. Service Level and Uptime

While we strive to maintain high availability, we do not guarantee uninterrupted service. We aim for 99.9% uptime but are not liable for downtime caused by factors beyond our control, including third-party service failures, internet outages, or force majeure events.

10. Termination

You may cancel your subscription at any time. We reserve the right to suspend or terminate your account immediately for violations of these terms. Upon termination, your instances will be suspended and may be deleted after a grace period. We are not liable for any loss of data resulting from termination.

11. Limitation of Liability

To the maximum extent permitted by law, Clawfather shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, secure, or error-free. You use our services at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Clawfather, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of our services or violation of these terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in [Jurisdiction].
